Photography Session Terms and Conditions

What forms of payment do you accept?

The retainer or session fees may be paid by cash (with a receipt provided), USPS money order, and credit/debit card (Visa, MasterCard, Discover and American Express) only.

Your Session date and time are not reserved until we receive your retainer fee or payment in full for the session.

**Please note** We DO NOT accept checks of any kind for payment of sessions with Abigayle Ray Photography LLC.

Portrait photography payment/retainer fee:   

(This includes: Engagements, Individuals/Couples/Families, Seniors & Maternity Portrait Photography Sessions)

Client agrees to pay Photographer non-refundable retainer to secure session date. Retainer must be no less than 50% of the total session fee. In addition, Client agrees to remit full balance no more than 30 days PRIOR to commencement of photo session plus any applicable taxes/fees.

Since we will reserve the time agreed upon and will not make another reservation for the specific period, retainers are non-refundable even if the date is changed or cancelled for any reason.

Wedding photography payment/retainer fee:

You have two options when it comes to paying for our wedding photography services.

Option 1. If your wedding is six (6) months or more away: A retainer of 30% of the total fees (plus tax if applicable) is paid at the time of reservation and signing of the wedding photography agreement. The balance is payable no later than 30 days prior to your wedding date.

Option 2. If your wedding is six (6) months or sooner: A retainer of 100% of total fees is paid at the time of reservation and signing of the wedding photography agreement.

Since we will reserve the time agreed upon and will not make another reservation for the specific period, retainers are non-refundable even if the date is changed or cancelled for any reason.

*Please note: This option is only available for our wedding clients at this time.

Why is my retainer non-refundable?

Once a date is reserved it can no longer be used for another client, therefore retainers are non-refundable. 

Inclement Weather: Rescheduling

Montana weather can change in literally minutes from nice and sunny to cold and snowing, even in the summer it can get rather cold here!  While we have no control over mother nature, we will do our best to work around any inclement weather. If we are unable to have your session due to inclement weather we will reschedule for the next available date & time. Rescheduling will be for the next available date. Please keep in mind that availability is limited so the next available date may not be for a few days.

For those that are vacationing here we strongly recommend scheduling your photography session as early in your visit as possible as this will allow extra time if a reschedule becomes necessary.


All retainers are a non-refundable. Clients are given one pass to reschedule for emergency purposes. Beyond that, you must place a new deposit to secure a new date. Should weather cause us to reschedule there is no fee for that. Once a session fee is paid in full there are no refunds, only reschedules.

Cancellation of Session by Studio:

In the highly unlikely event of cancellation of your session by Abigayle Ray Photography LLC, the Studio’s liability shall be limited only to a full refund of any retainer fee(s) paid by the Client to the Studio at the date/time of Cancellation.

It is agreed to by all parties that the Studio will have up to sixty (60) business days from the date of notice of the cancellation to refund the retainer fee(s) to the Client. This is the only exception to the refund policy of Abigayle Ray Photography LLC.

Refund Policy:

Due to the nature of digital photography Abigayle Ray Photography LLC has a strict NO REFUNDS POLICY. If a Client is dissatisfied with the work they receive, the Client must notify the Studio so that a re-shoot of the session (at no additional charge) can be scheduled at the Clients convenience and also the Studios schedule as we normally book weeks and months in advance. Refunds will NOT be given due cancellation of the Session, not liking a photo(s) (Specific Image), not getting a specific pose you wanted, selecting an incorrect location or background, or for any other reason whatsoever. Please see your contract for further details including how to reschedule your Session if needed.

Punctuation Please:

It is very important that you arrive to your session on time and ready to begin. Our specific appointment time is set aside just for you. Please make every effort to be time so that you can receive your full session. Being late or not ready to start will cut into to our shooting time. Showing up more than 30 minutes late may result in a forfeit of your session and session fee. Please limit attendance to those being photographed to keep down distraction.

Client Cooperation:  

The Studio cannot perform the Assignment without the cooperation of the Client(s). If Client fails to communicate with the Studio (ie: changing Session dates, times, locations etc), fails to show for Session, arrives late to session without prior contact, then the Studio will deem said actions as a cancellation. If the Studio contacts the Client for any reason it is expected that the client will communicate back as soon as possible.

Location Access and Fees:

If the Client wants to do a session at a location that charges for access, the Client will be responsible to cover fees associated with photographing there, and you will also responsible for organizing the access and any permits (if required) related to doing so.

Client is also responsible for any parking fees or tolls/paid access (such as entry fee to Yellowstone NP). These fees will be in addition to your session fee. 

What's the best time of day to take photos?

Photographers call it the golden hour. The 1-2 hours before the sun sets is the best time to shoot. You get the most amazing warm, glowing light during this time. This time may vary at different parts of the year.

How long will the session last?

Session times vary, but an average session lasts anywhere between 1.5 and 2  hours. This does not include weddings.

Client's Use of Photographs:

Client may use the photographs taken pursuant to this Agreement for personal, non-commercial purposes, including display on personal websites and copies for family and friends, if, when customary, credit is given to Photographer as "© Abigayle Ray Photography." Client agrees to not permit or assist with any commercial use or sale of the photographs without specific written consent of Photographer.

Artistic Image Selection:

Abigayle Ray Photography LLC will capture many images during your Session. After the session, the photographer exclusively puts each image through a careful selection process. You will see only the images in an online gallery or your USB Drive that meet the high standards of the photographer. Images captured of eyes closed, people talking, unflattering poses and duplicate images are removed permanently after Abigayle Ray Photography LLC completes this selection process. The selection process is done at the sole discretion of the photographer and is part of the custom portrait process. A few images will be presented in black and white. These are produced at the photographer’s discretion. If you would like additional images presented in black and white, there is an additional fee.

Limits of liability:

If Studio can’t perform this Agreement in whole or in part due to a fire or other casualty, acts of God, acts of Nature (including but not limited to weather), acts of terror, or other cause beyond the control of all parties or due to Photographer's illness, injury or death, then Studio will reschedule the Session at a date and time that is convenient to both parties for up to one (1) year from the original session date. The limitation of liability also applies in the event that photographic materials are lost or damaged in processing, lost or damaged through camera malfunction, lost or damaged in the mail, or otherwise lost or damaged without fault on the part of Photographer.

Copyright of Images:

Copyright for all images is the sole property of Abigayle Ray Photography LLC and protected by the Federal Copyright Law (Title 17 of the U.S. Code). It is ILLEGAL to copy, scan, print or reproduce these images in any way without written permission from the photographer. This includes scanning or downloading images for the purposes of emailing or printing them at home. It is a violation of copyright to screen shot or scan your images and upload them to social media sites. Cropping a "screen shot" of images which is then used in cards, announcements, collages, or any other use are a direct violation of your agreement. Please also inform family members of these rules. These rules are NOT negotiable and will be enforced. If you are found to be in violation of this agreement, you will be sent a written notification and the appropriate actions will be taken. Only those clients who purchase their digital files may use images to create their own cards, announcements, etc.

PLEASE NOTE: ANY violation of Copyright will result in IMMEDIATE PURGING of all your files and you will be removed as a client of Abigayle Ray Photography LLC. If you are a multiple session Client, any remaining sessions will be forfeited without compensation or refund.

Studio’s Standard Price List:

The charges and prices are based on Abigayle Ray Photography LLC's Current Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed. If you reserve and pay for a Session and then we change the Pricing, what's included in the Package, or Both, you will receive the Session you paid for originally and NOT the new Package or Pricing.
